


Wrongful Death
If a loved one, member of your family, spouse, parent, or child dies because of someone’s careless or negligent act, the law allows the surviving family to bring a wrongful death action. The death can be as a result of:
The wrongful death law in New York allows the surviving family to recover the loss of their loved one’s financial support along with compensation for any pain and suffering the person experienced before their death.
You have two years from the date of death to start a lawsuit. If the death is caused by a municipal or government hospital or organization, such as SUNY Upstate and Community General Hospital, the time limits are much shorter – you have only 90 days to protect yourself.
While it is difficult to think about a lawsuit at the time of a loved one’s death, it is important that an investigation into the facts surrounding the death be started as soon as possible.
